CONDITIONS OF USE
Use of this Island Trading Limited (Island Trading) website www.islandtrading.bm and/or www.islandtradingbermuda.com (website) constitutes an agreement to our terms of use. We encourage you to review the following information carefully before using the website.

SALES TERMS AND CONDITIONS
The placing of an order with us does not constitute a contract. The contract is formed only when your order is expressly accepted. Acceptance of an order will be subject to:
• The products ordered being available from stock.
• Our obtaining authorization for payment.
• The identification of a pricing or product description error, in which case we will contact you to check whether you wish to proceed with or cancel the purchase of that item.

Island Trading prides itself on our extensive product knowledge as well as the particulars of our corrosive climate. We always do our best to advise our customers on the best product for their particular needs. It is important, however, to bring special attention to the following;

Products can vary slightly by colour, dimensions and finishes. This is due to the nature of some of the materials used in our furniture, such as teak wood, or the manufacturer making changes without reference to us and over which we have no control. These changes are deemed by the manufacturer as improvements to the original. All stock that arrives at our showroom has protective wrapping. Island Trading removes these wrappings to inspect all items to make note of any of these changes or any damage incurred during shipping. We reserve the right to make any alterations or adjustments to any received item which may be required before or after delivery.

WEATHERING
Teak furniture that is exposed to the elements will undergo a natural weathering process. The exact manner and speed at which this occurs depends on the level of exposure, local climate and weather, and natural variations in the wood.
Weathering is commonly associated with four characteristics:
1. Teak oil surfacing: Teak wood is rich in natural oil, which makes it stable in extreme climates and resistant to bugs and rotting. When furniture is new, these oils can surface during damp or humid conditions, leading to discoloration of cushions and upholstery. It's important to note that teak oil stains are not covered under warranty. To help prevent discolouration, it's recommended that you remove cushions from frames and pull sling chairs out from beneath teak dining tables when the furniture is not in use. Additionally, it is recommended to leave the lids on new teak cushion-boxes open to expose their interior to the elements, and avoid storing cushions inside until you notice the natural colour change of the interior. Once the furniture has had a chance to weather and begins to form a silver-grey patina, typically after a few rainfalls, these precautions should no longer be necessary.

2. Grain lifting: New teak furniture is sanded to a very smooth factory finish. However, when the furniture is exposed to moisture, the finish may feel slightly rough due to a natural lifting of the grain. This is normal and the finish will gradually return to a smooth surface through normal use and with time. If desired, you can also help this process along by gently sanding the surfaces you come in contact with, such as the arm of a chair, with a fine grit sandpaper (320 grit). Always remove cushions prior to sanding, sand in the direction of the wood grain, and do not power sand. Once you are done sanding, wipe all furniture surfaces thoroughly with a damp cloth to remove any teak dust, and allow the furniture to dry.

3. Checking: Teak wood naturally expands and contracts with changes in temperature and humidity, which can result in small cracks or “checking” on surfaces of the furniture. Checking is cosmetic only and typically has no impact on the structural integrity of the frame. As checking is a natural part of the weathering process, and almost always cosmetic in nature, it is not covered by warranty. However, in rare cases where a crack becomes exceptionally large or occurs in a location which interferes with the stability of the furniture and renders it unsafe for usage, do not use the furniture, and immediately contact us for guidance.

4. Color change: When used outdoors, teak wood will gradually form a handsome silver-gray patina. This process can take nine to twelve months depending on climate, weather conditions, and level of exposure. Initially, you may notice water spots from rain. These are normal and will even out with time and continued exposure to the elements. To allow furniture to develop the gray patina, use only soap and water to clean your furniture. Do not use bleach, chemicals, or abrasive cleaners as these products will remove the grey patina and return the wood to a brown colour. If you wish to maintain or restore the brown colour of new teak, use a teak cleaner followed by periodic applications of a teak protector.

Some materials used for the manufacturing of products are subject to adverse effects caused by our unique, often corrosive environment. High levels of humidity, strong sunlight and salt can affect certain materials, fabrics and colours. Island Trading does our best to avoid the purchase of products which can be affected. It is important to note that natural wood does absorb moisture and can expand causing small gaps at joints and warping.

Lacquer and painted products are subject to minute cracks if the wood beneath expands. These imperfections are rare, and do not affect the overall integrity of the piece. If you feel that this sort of imperfection would be bothersome to you, serious consideration should be given to the alternative finishes.

Whenever possible, Island Trading’s products are tried and tested. However, we cannot accept responsibility for special order items, not regularly stocked by our showroom, and where we have no prior experience as to durability.

Woven fibres and fabric colours can vary slightly between dye-lots. If you intend to “add on” at a later date, please discuss this with one of our team members.

Many of our furniture suppliers offer warranties on their products. Where there are warranties on a particular product, Island Trading will work to find a solution on your behalf to rectify any product failures. Should a warranty not exist, we will do our best to find a solution provided there is no evidence of misuse.

PAYMENT TERMS
Payment will be due immediately upon the issuance of an invoice to you, or on such terms as may otherwise be agreed. Title in the product will pass to you when you have paid for such product in full.

PICK-UP & DELIVERY
Island Trading currently offers collection at our showroom at 93 Reid Street in Hamilton. When your order is ready for pick up you will receive an email or phone call with instructions. We endeavour to have purchases ready for pick up with one business day. However, we will do our best to shorten this processing period. Our pick up times are Monday - Saturday, between 8:30 a.m. and 5:30 p.m.

• We partner with Joe Vieira Trucking for our furniture deliveries requiring 2 people to carry/deliver.
• Delivery days are typically Tuesday, Thursday and Saturday. Once your order is placed, we will be in contact with you to arrange a delivery day and obtain any special instructions. If there is a specific day that you would like to request, please do so and we will do our best to accommodate.
• White glove delivery involves special care during wrapping, delivery and set up. We will place furniture and ensure it is set up in your indoor our outdoor space.
• What you can expect from us – a phone call from our team to agree your delivery date and any special instructions when we arrive. We will then contact you the morning of the delivery to confirm an approximate window of time that our team will arrive at your home. Kindly note that we outsource our trucking and our truckers may have commitments to additional customers that day, therefore we are not able to arrange for the collection of old furniture or the moving of existing furniture. (We can certainly provide contact information to contact Joe Vieira directly to arrange for removal in advance.) Kindly ensure the area is ready to receive you fabulous new Island Trading furniture!
• Complimentary delivery and white glove set up for all furniture orders over $2,000. $125 for any orders below $2,000.
• For items that can be delivered in a van, we offer delivery island-wide within 2 business days for $15 per order.

SPECIAL ORDER SERVICE
Island Trading. offers a special order service for items not stocked in the showroom from its existing suppliers. There is no additional charge for this service. Please contact us to discuss your special order items.

Standard lead time is approximately 6-8 weeks, but product lead times vary between manufacturers. We will do our best to liaise with the specific manufacturer in order to provide a more accurate lead time for specific orders and we will notify you of this lead time.

We require a 50% deposit on all special orders. The balance is due on arrival, and customers should be ready to receive items promptly.

CLAIMS AND SERVICE
Island Trading has a 14 day return policy for stock purchases.
All special order and sale items are final and non-refundable.

PRIVACY
We use the Order Information that we collect to fulfil any orders placed through the website (including processing your payment information and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to communicate the following with you:

Screen our orders for potential risk or fraud.
We do not collect any other information and share it with other companies or individuals.

LIMITATION OF LIABILITY

Island Trading will not be responsible for any damages of any kind resulting from use of this website, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

APPLICABLE LAW
By visiting this website, you agree that the laws of the Islands of Bermuda, without regard to principles or conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Island Trading.

CHANGES IN POLICY
Island Trading reserves the right to modify, alter, delete and update these policies at any time we see fit. Such changes do not nullify our rights regarding any infringements or breaches that occurred under a previous version of these conditions.

8. Closed-Circuit Television (CCTV)
We use CCTV to monitor our premises to help maintain a safe and secure environment for our customers and employees and in compliance with data privacy legislation.
• Cameras are in public areas.
• We do not use covert monitoring or surveillance.
• Signs are displayed at the entrance to our premises.

Purposes of our CCTV System
• The personal safety of our employees, customers and visitors;
• To support our health and safety measures;
• To support law enforcement in the prevention, detection and prosecution of crime; and,
• To protect our premises and assets (including personal information) and those of our employees, customers and visitors from damage, disruption, vandalism and other crime.

Conditions for Processing
• We will not process CCTV footage unless it captures criminal activity, a security matter or a health and safety incident.
• We may need to use this personal data to establish, exercise or defend against legal claims.

Access and Disclosure
• Access to recorded CCTV footage is restricted to approved members of staff whose role requires them to have access to such data.
• CCTV footage will only be accessed or disclosed if it is necessary to deal with an incident which falls within the purposes identified above or to respond to an individual request.
• CCTV data will only be disclosed to a third party where there is a lawful reason or where required by law.
• CCTV footage will not be accessed or used for any other purpose.
• Access to recorded CCTV footage may be accessed by Selectron in an emergency.

Retention and Security
• CCTV footage is kept for 30 days when it is automatically erased, unless required for a specific investigation (such as criminal damage when it will be kept only for the duration of that investigation).
• We have security measures in place to protect CCTV data.

9. Individual Rights
Every individual has the following data privacy rights:
• The right to be informed: You have the right to know the purposes for which we collect your personal information, how it will be used, and whether it will be shared with third parties.
• The right to access: You have the right to ask us for copies of the personal information we hold about you. This right always applies. We may charge a small fee for this service.

We reserve the right to limit the quantities of any products or Services that we offer.
